ABIS Arms, LLC Consignment Agreement
Consignor agrees to place the item(s) listed below on consignment with ABIS Arms, LLC (Consignee) to try to sell them under the terms of this agreement. ABIS Arms, LLC agrees to accept the item(s) listed for consignment sale under the terms of this agreement. ABIS Arms, LLC will:
1. Inspect item(s) listed on this agreement
2. Service and prepare the item(s) for listing for sell
3. Advertise and market the item(s) for sell as ABIS Arms, LLC deems appropriate
When the item(s) consigned is/are sold and final payment is made by the buyer, the Consignor will receive their net amount within 10 days via business check. If the check is not picked up by the Consignor after 10 days, ABIS Arms, LLC shall mail the check to the address listed on this agreement. The Consignor represents that they are the rightful owner of the item(s) listed, and that the item(s) are free of any encumbrance. The Consignor agrees that, as ABIS Arms, LLC is required to complete all inspections, prepare the item(s) for sale, and advertise the item(s), that the item(s) consigned will be left on consignment with ABIS Arms, LLC for a minimum of 60 days.
After 60 days, if not sold, consignor must pick up firearm or this agreement will automatically renew on the 61st day. This agreement shall automatically renew for a maximum of 180 days. After the maximum consignment period of 180 days have passed, if the item(s) have not sold, the Consignor must pick up the item(s) within 10 days. If not picked up a $5.00 per day storage fee will be assessed starting on the 11th day after the expiration of this agreement, NO EXCEPTIONS! If firearm is not picked up within 30 days after agreement expires, the firearm becomes property of ABIS Arms, LLC. While this agreement is in effect, Consignor agrees to grant the exclusive right to market and sell the item(s) listed below to ABIS Arms, LLC.
ALL ITEM(S) MUST BE IN GOOD CONDITION AND CLEAN: Consignee reserves the right not to display any consigned item found on close inspection to be defective. Such item(s) not reclaimed by the consignor within 10 days of notification by ABIS Arms, LLC shall be charged a $5.00 per day storage fee. If item(s) are not picked up within 30 days after notification, the firearm becomes property of ABIS Arms, LLC.
LIABILITY:
Consignee shall not be liable to Consignor for any loss or damage suffered to Consignor's merchandise, including, but limited to, loss or damage to such merchandise from fire, theft, or other casualty. Consignor hereby fully releases Consignee to the fullest extent possible under the law from any and all claims or any nature in connection with or arising from the placement of Consignor's merchandise with Consignee. Consignor further covenants that he/she shall make no claim against Consignee, Consignee’s insurance carrier or the property owner where the items are being stored or held for any damage to Consignor’s merchandise.
Cancelled Consignments:
Because a sell may be pending or an ad placed, the Consignor agrees to give ABIS Arms, LLC 30 days’ notice shall the Consignor wish to terminate this agreement.
Federal Law requires that the Consignor complete all appropriate forms as if they were purchasing the firearms and pass the NICS background check and consignor agrees to pay ABIS Arms, LLC $25.00 for transfer fees. If consignor fails either the documentation or NICS check the firearm becomes the permanent property of ABIS Arms Firearms, LLC. In the event the consignment item(s) do not sell within the maximum 180-day consignment period, ABIS Arms, LLC will waive the $25.00 transfer fee when returning the item(s).
Consignment Fee:
The consignment fee shall be 12.5% of the selling price of the item, with a minimum fee of $35 per item, and a maximum fee of $1000 per item.
